Update to guidance on the review of warnings issued by GDC Investigating Committee

Update to guidance on the review of warnings issued by GDC Investigating Committee

On 13 April 2016, we secured a change to our legislation to enable registrants issued with warnings by our Investigating Committee to seek a review of those decisions. This new power enables registrants to seek a review up to two years after the decision was made.

To ensure certainty on existing decisions that were made prior to the commencement date of this new power, we introduced guidance that restricted the right to seek a review for warning decisions issued only after 13 April. A registrant issued with a warning some days prior to 13 April 2016, challenged this guidance by judicial review. On 14 December 2016, the High Court disagreed with our interpretation. We have as a result removed this restriction from our guidance, which is available on our website.
